These terms govern your use of colossalfinance.au. Please read them before you use the site.

1. Who we are

This website is operated by Colossal Finance Pty Ltd (ABN 52 623 073 432) (“Colossal Finance”, “we”, “us”, “our”) of Level 2, 493 St Kilda Road, Melbourne VIC 3004.

Colossal Finance is a Corporate Credit Representative (Credit Representative Number 556118) of Quantum Business Finance Pty Ltd (ACN 135 253 191), holder of Australian Credit Licence Number 395230.

We are a member of the Australian Financial Complaints Authority (Membership Number 105018) and of the Commercial & Asset Finance Brokers Association of Australia (Membership Number 296182).

2. Accepting these terms

By accessing or using this website, you agree to these terms. If you do not agree with them, please do not use the website.

These terms should be read together with our Disclaimer and our Privacy Policy.

3. What this website is — and what it isn't

This website provides general information about Colossal Finance and the types of finance we arrange.

It is not an offer of credit, an application for credit, or credit assistance. Using this website does not create a client relationship between you and us, and does not oblige us to act for you or to arrange finance for you.

Information on this website is general only and does not take account of your objectives, financial situation or needs. Our Disclaimer sets this out in full and forms part of these terms.

4. Using this website

You may use this website for lawful purposes connected with considering or obtaining finance, or learning about our services.

You must not:

  • use the website in a way that breaches any law, infringes anyone's rights, or is fraudulent or misleading;
  • attempt to gain unauthorised access to the website, our systems, or any data on them;
  • interfere with the operation, integrity or security of the website, or introduce malicious code;
  • scrape, harvest or systematically extract content or data from the website, or use automated means to access it, without our written consent; or
  • use content from the website to build or train a commercial product or dataset without our written consent.

We may restrict or withdraw access to the website, or to any part of it, where we reasonably consider it necessary to protect the website, our clients or our business.

5. Enquiries and information you send us

If you send us an enquiry through this website, by email or through any form on it:

  • you are asking us to contact you; you are not applying for finance and we are not obliged to act for you;
  • you must make sure the information you give us is accurate and that you are entitled to provide it, including where it relates to another person or entity; and
  • we will handle any personal information in accordance with our Privacy Policy.

We may need to give you further disclosure documents, and obtain your consent, before we can act for you or make enquiries with lenders or credit reporting bodies on your behalf.

6. Our content

We own, or are licensed to use, the copyright and other intellectual property rights in the content of this website, including text, images, graphics, logos, video and design.

You may view, download and print content from this website for your own personal or internal business use, or to consider our services, provided you:

  • do not alter the content; and
  • keep any attribution, copyright notice or trade mark that appears on it.

Any other use — including reproducing, republishing, distributing or commercialising our content — needs our written permission first.

“Colossal Finance” and our logos are our trade marks. You must not use them without our written consent.

We do not control those websites or that material, we do not endorse them by linking to them, and we are not responsible for their content, accuracy or availability, or for how those parties handle your information.

8. Availability and security of the website

We aim to keep this website available and working properly, but we do not promise that it will be available at all times, free of errors, or free of viruses or other harmful code.

You are responsible for your own systems and for taking reasonable precautions, including your own virus protection, before downloading anything from this website.

We do not guarantee the security of information transmitted to or from this website. Please do not send us sensitive or identity documents by unsecured email.

We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy explains what we collect, how we use it, who we disclose it to — including service providers and lenders located overseas — and how you can access or correct it, or make a privacy complaint.

This website uses cookies and similar technologies, including analytics and advertising tools operated by third parties, to help the site work and to understand how it is used. 10. If you engage us

These terms cover your use of this website only.

If you engage us to arrange finance, that engagement is governed by the documents we give you at the time, which may include our Credit Guide, our Privacy Disclosure Consent and Appointment to Act, and any letter of engagement or fee agreement.

If there is any inconsistency between those documents and these terms, those documents prevail for the engagement.

11. Your rights, and the limits of our responsibility

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, that applies to you under the Australian Consumer Law, the Australian Securities and Investments Commission Act 2001 (Cth) or any other law where it cannot lawfully be excluded, restricted or modified.

Subject to that:

  • we exclude all warranties, conditions and representations about this website that are not expressly set out in these terms;
  • we are not liable to you for any loss or damage — including loss of profit, loss of revenue, loss of data or any indirect or consequential loss — arising out of or in connection with your use of, or reliance on, this website, other than loss or damage caused by our negligence, fraud or breach of law; and
  • where our liability cannot be excluded but can be limited, our liability is limited, at our option, to supplying the relevant information or services again, or paying the reasonable cost of having them supplied again.

Nothing in this clause limits any liability we have to you in connection with credit assistance we actually provide to you, which is dealt with under the documents referred to in clause 10 and under the law that applies to that assistance.

12. Your responsibility to us

You are responsible to us for loss we suffer to the extent it is caused by:

  • your use of this website in breach of clause 4; or
  • your infringement of our intellectual property rights or those of a third party.

This does not apply to the extent the loss was caused or contributed to by us.

13. If something goes wrong

If we cannot resolve your complaint, or you are not satisfied with our response, you may be able to take it to the Australian Financial Complaints Authority (AFCA), which provides free and independent external dispute resolution:

14. Changes to these terms

We may update these terms from time to time, for example to reflect changes to the website, our services or the law.

The version published on this page applies to your use of the website from the time it is published. Changes do not apply retrospectively to any matter already dealt with between us. We will show the date of the most recent update at the top of this page. Please check the terms each time you use the website.

15. General

  • Governing law. These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts that hear appeals from them.
  • Severability. If any part of these terms is unenforceable, it is severed and the rest continues to apply.
  • Entire terms. These terms, together with our Disclaimer and Privacy Policy, are the entire agreement between you and us about your use of the website.
